These Terms & Conditions ("Terms") govern your use of the Dayuplan Enterprises Limited ("Dayuplan," "we," "us," or "our") website and our LPG distribution, delivery, installation, and maintenance services across Lamu, Kilifi, and Tana River County. By placing an order or using our website, you agree to these Terms.
1. Our Services
Dayuplan supplies and distributes LPG cylinders and bulk tanks, including brands such as SEA Gas, PRO Gas, Mpishi, Hashi, and Top Gas, to households, retailers, wholesalers, hotels, restaurants, institutions, and businesses. We also provide installation, maintenance, safety inspection, and home delivery services.
2. Orders & Payment
- Orders can be placed by phone, WhatsApp, or through our online order form.
- You are responsible for providing accurate delivery and contact information.
- Payment is due on delivery unless you hold an agreed business or institutional account.
- We reserve the right to decline or cancel an order where delivery is not safely possible.
3. Delivery
We aim to deliver within the timeframe confirmed at the time of your order. Delivery times may vary depending on your location, weather, and road conditions, particularly in more remote parts of Lamu, Kilifi, and Tana River County. Someone must be available to receive and, where applicable, assist with cylinder setup at the delivery address.
4. Cylinders & Deposits
Gas cylinders supplied by Dayuplan remain our property unless otherwise agreed. Where a cylinder deposit or exchange arrangement applies, this will be communicated to you at the time of order. Cylinders must be returned in a safe, undamaged condition for refilling or exchange.
5. Customer Safety Responsibilities
Customers are responsible for the safe use, storage, and handling of LPG cylinders and equipment after delivery, in line with the safety guidance provided by our delivery and installation team. If you notice a leak, damage, or fault, disconnect the cylinder if safe to do so and contact us immediately.
6. Installation & Maintenance Services
Installation and maintenance services are carried out by our qualified technicians. Modifications made to your gas system by unauthorized third parties may affect the safety and validity of our installation or maintenance work.
7. Business, Wholesale & Institutional Accounts
Retailers, wholesalers, and institutions with customized supply contracts are additionally bound by the specific terms, pricing, and delivery schedules agreed in their individual account arrangements with Dayuplan.
8. Limitation of Liability
While we take safety and reliability seriously, Dayuplan is not liable for delays or failures caused by circumstances beyond our reasonable control, including weather, road access, or misuse of equipment after delivery. Nothing in these Terms limits any liability that cannot be excluded under applicable Kenyan law.
9. Changes to These Terms
We may update these Terms from time to time. Continued use of our services or website after changes are posted constitutes acceptance of the revised Terms.
10. Governing Law
These Terms are governed by the laws of Kenya.
